Welcome to Liyamado! These Terms of Use and Service govern your access to and use of our platform, products, and services. By accessing or using the Liyamado platform (“Platform” shall refer to all relevant applications and websites), you agree to comply with these Terms. Please read them carefully.
You must be at least 18 (eighteen) years of age before you can use the Liyamado platform. By using this platform, you warrant that you are at least 18 years of age and you may legally adhere to this Agreement. Liyamado platform assumes no responsibility for liabilities related to age misrepresentation.
I. General Use and Services
- By using the Liyamado platform or services, you agree to these Terms of use and our Privacy Policy. If you do not agree with any part of these terms, please discontinue your use of our platform.
- Using this platform or opening a Liyamado account (“User”, “You” or “Your”), you are aware of your legal rights and obligations with respect to Liyamado platform and its affiliates and subsidiaries (individually and collectively, “Liyamado”, “we”, “us” or “our”).
- The “Services” we provide or make available include (i) the platform, (ii) the services provided by the platform and by Liyamado client software made available through the platform, and (iii) all information, linked pages, features, data, text, images, photographs, graphics, music, sounds, video, messages, tags, content, programming, software, application services (including, without limitation, any mobile application services) or other materials made available through the platform or its related services (“Content”). Any new features added to or augmenting the Services are also subject to these Terms of Service. These Terms of Service govern your use of Services provided by Liyamado.
1.2 As a user of this platform, you may be asked to register with us and provide private information. You are responsible for ensuring the accuracy of this information, and you are responsible for maintaining the safety and security of your identifying information. You are also responsible for all activities that occur under your account or password. If you think there are any possible issues regarding the security of your account on the website (see PRIVACY POLICY) or inform us immediately so we may address them accordingly. We reserve all rights to terminate accounts, edit or remove content and cancel orders at our sole discretion.
1.3 Our Services include an online platform service that provides a user to sell a product between the buyer (“Buyer”) and the seller (“Seller”) (collectively “you”, “Users” or “Parties”). The actual contract for sale is directly between Buyer and Seller and Liyamado platform is not a party to that or any other contract between Buyer and Seller and accepts no obligations in connection with any such contract. Parties to such a transaction will be entirely responsible for the sales contract between seller and buyer, the listing of products, warranty of purchase and the like. Liyamado platform is not involved in the transaction between Users. We may or may not pre-screen Users or the Content or information provided by Users. This platform reserves the right to remove any Content or information posted by you. We cannot ensure that Users will actually complete a transaction.
1.4 Users understand that Seller bears all risk attached to the delivery of the purchased item(s) and warrants that he/she has or will obtain adequate insurance coverage for the delivery of the purchased item(s). In the event where the purchased item(s) is damaged or, lost during the course of delivery or where there is failure of delivery, Users acknowledge and agree that Liyamado will not be liable for any damage, expense, cost or fees resulting therefrom and Seller and/or Buyer will reach out to the Logistics Service Provider that selle made to resolve such dispute.
1.5 This platform reserves the right to change, modify, suspend or discontinue all or any part of this platform or the Services at any time or upon notice as required by local laws. Liyamado may release certain Services or their features in a beta version, which may not work correctly or in the same way the final version may work, and we shall not be held liable in such instances. Liyamado may also impose limits on certain features or restrict your access to parts of, or the entire, Site or Services in its sole discretion and without notice or liability, including, but not limited to, your failure to comply with these Terms of Service.
II. PAYMENT POLICY
We aim to provide secure and flexible payment options for all our user. This Payment Policy explains how payments are handled through our trusted payment partners.
Please read these terms carefully before using the online payment facility. Using the online payment facility on this platform indicates that you accept these terms. If you do not accept these terms do not use this facility.
Terms and Conditions:
- Liyamado platform shall process all instructions received using the information you provide. You shall accept full responsibility for all transactions processed through the use of such information whether or not processed with your knowledge or by your authority.
- By purchasing products on the Liyamado platform, you agree to pay all applicable fees, including taxes and handling charges.
- We accept payments through secure gateways, including credit cards, debit cards, and other online payment options allowed in the Philippines. Buyers may only change their preferred mode of payment for their purchase prior to making payment.
- Your access to the Liyamado platform through third-party network providers is subject to their respective terms and conditions. The security of data transmitted through such networks is covered by the governing policies of the network provider.
- We shall not be responsible for any charges imposed on you or any other action taken against you by a seller arising from non-processing of your payment due to your failure to follow exact payment instructions.
- We are not be held liable against any and all proceedings, claims, losses, damages or expenses, including legal costs, that arise from your use of our payment transaction.
- All payments made through this platform are final and executory. However, the Liyamado platform reserves the right to not process a transaction due to internal reasons. Such payments may be subject to refund (see Refund Policy).
- We shall not be held liable for delays in processing of your payment due to corresponding delays, system problems, internal maintenance, or maintenance with our payment collection partners. The Liyamado platform will not be compelled to explain the reasons for such incidents.
- All online payment transactions are processed securely through third-party payment gateways using SSL encryption.
- Liyamado platform takes no responsibility and no liability for any loss or damages to Buyer arising from shipping information and/or payment information entered by Buyer or a wrong remittance by Buyer in connection with the payment for the items purchased. We reserve the right to check whether Buyer is duly authorised to use a certain payment method, and may suspend the transaction until such authorisation is confirmed or cancel the relevant transaction where such confirmation is not available.
- Excess portion of your payment is forfeited. Payments less than the amount due will not be processed.
III. RETURN AND REFUND POLICY
We strive to ensure that our customers are satisfied with their purchases. If you are not entirely satisfied with your purchase, we follow the Consumer Protection Act of the Philippines. We’re here to help and offer refunds under the conditions.
- Eligibility for Refunds
We offer refunds on purchases made through our platform, subject to the following conditions:
1.1 Items were not received within the Seller extent on delivery time frame.
1.2 Products must be returned within 30 days from the date of purchase.
1.3 The product must be in its original condition, unused, and with all tags or packaging intact.
1.4 Proof of transaction from buyer (receipt or order confirmation) is required for all refund requests.
1.5 We may require you to provide additional information prior to processing any refund.
1.6 Processing Refund may take 15 – 30 days prior to date request.
- Refund Process
To request a refund, please follow these steps:
2.1 Contact our customer service team at support@liyamado.com within the request refund period.
2.2 Provide details of the order and the reason for the return.
2.3 Once your refund request is approved, you will receive instructions for returning the product (if applicable).
2.4 Refunds will be processed to the original payment method, and may take 5-10 business days to appear in your account.
